Petitioner has filed this writ petition seeking following reliefs:- 2 “A. That this Hon’ble Court may be pleased to set aside/quash the order No. Est. 02/ukti/2025-26/1704 dt. 18.06.2025 (Annx. P-1) passed by the respondent no. 2 with a direction to correct the list of teacher (L.B.) as per the date of taking charge of teacher (L.B.) not as per the first appointment order. B. Any other relief, which this Hon’ble Court may deem fit and proper according to the facts and circumstances of the case along with the cost of the petition.” 2. Learned counsel for petitioner submits that petitioner was transferred from Govt. Middle School PV.113 which comes under Block Koilibeda at District Kanker to Middle School Murtonda at Block Sukma, District – Sukma under the Rationalization Policy treating the petitioner to be in surplus. He submits that while taking the petitioner as surplus teacher some error has been kept against which petitioner has submitted a representation before the Commissioner, Bastar on 28.11.2025 which till date is pending consideration. 3. Learned counsel for State submits that the order of transfer is of dated 18.06.2025. Petitioner though submitted representation before not the authority as constituted by the State Govt. under the Rationalization policy. The State Govt. has constituted three tier committee to consider the grievance of the teachers who are aggrieved with their place of posting and transfer of teachers under the Rationalization Policy i.e. the District Level Committee headed by District Education Officer and State Level Committee headed by Directorate of Public Instructions. 4. At this stage learned counsel for the petitioner submits that he may be permitted to submit fresh representation before the Divisional Level Committee headed by Divisional Commissioner and direction be 3 issued to the Divisional Level Committee to consider and decide the representation at the earliest. 5. On due consideration of submission made by learned counsel for the respective parties, this writ petition at this stage is disposed of permitting petitioner to submit comprehensive representation raising all the grounds as raised in this writ petition before the Divisional Level committee and if such a representation is submitted, concerned committee shall consider and take decision on the same, in accordance with law, expeditiously, preferably within a further period of 02 months from the dated of receipt of the representation. 6. With the aforesaid observation and direction, this writ petition stands disposed of.
