The petitioners are apprehending their arrest in connection with Lawalong P.S. Case No.02 of 2026, for the offence registered under Sections 316(2), 318(4), 126(2), 115(2), 351(2), 303(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the court of learned C.J.M., Chatra. 2026:JHHC:13512 --2-- A.B.A. No. 2121 of 2026 3. Learned counsel for the petitioners submits that during the pendency of this anticipatory bail application petitioner No.1 has been arrested and in that view of the matter, he is not pressing the petition in respect of petitioner No.1, namely, Navin Prasad Sahu. He submits that now this petition is surviving only for petitioner Nos.2 and 3. 4. In view of his such submission, the anticipatory bail of petitioner No.1, namely Navin Prasad Sahu, is rejected as not pressed. 5. Learned counsel appearing for the petitioners submits that so far petitioner Nos.2 and 3 are concerned they are the family members of Navin Prasad Sahu and the amount has been taken by Navin Prasad Sahu on the pretext of providing job. He further submits that so far these two petitioners are concerned anticipatory bail may kindly be granted. 6. Learned counsel appearing for the State and Informant jointly opposed the prayer and submits that petitioner Nos.2 and 3 happened to be family members of Navin Prasad Sahu. 7. In the complaint case, which has been converted into FIR later on, the allegations are there against Navin Prasad Sahu for taking Rs.5 lacs on the pretext of providing job. So far petitioner Nos.2 and 3 are concerned they are the family members and that allegation is not there against them. In the attending facts and 2026:JHHC:13512 --3-- A.B.A. No. 2121 of 2026 circumstances of this case, I am inclined to provide privilege of anticipatory bail to petitioner Nos.2 and 3, namely, Pravin Kumar and Radheshyam Prasad. 8. Accordingly, the petitioner Nos.2 and 3 above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioner Nos.2 and 3, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned C.J.M., Chatra in connection with Lawalong P.S.
