L Counsel for the Respondents:GP FOR REGISTRATION AND STAMPS The Court made the following order: 4 THE HONOURABLE SRI JUSTICE RAVI NATH TILHARI THE HONOURABLE SRI JUSTICE PURUSHOTTAM KUMAR CHINTALAPUDI I.A.No.2 of 2026 In/and WRIT APPEAL NO: 610 OF 2026 ORDER: (per Ravi Nath Tilhari, J) Heard Sri Vutupalli Rajanna, learned counsel for the appellants; Sri G.L.Narasimha Reddy, learned counsel for respondent No.1 and Sri K.Dilip Naik, learned Assistant Government Pleader for respondent Nos.2 to 5 and perused the material on record. 2. Respondent No.1 is the writ petitioner in W.P.No.14718 of 2023. The writ petition was disposed of on 07.03.2026, challenging the same the present writ appellants who are the third parties to the writ petition filed this writ appeal along with I.A.No.2 of 2026 seeking leave to file the appeal. 3. The leave has been sought on the ground that the writ appellants purchased the subject property from the original vendor. 4. Learned counsel for the writ appellants submits that the writ petition was filed by respondent No.1 without impleading the original vendor or the writ appellants in the writ petition. He further submits that the respondent No.1 (writ petitioner) filed an application before 5 respondent No.4 for registration of the subject land in the writ petition. The same was rejected vide Order No.11/2015, dated 21.05.2015 on the ground that it was in prohibited list and against the same, the writ petitioner filed an appeal which was rejected on 10.03.2023. The rejection was on the ground that subject matter of the agreement of sale said to be from the same owner in favour of the writ petitioner was within the prohibited list. The appeal was dismissed on the ground of limitation. 5. Learned counsel further submits that before the learned Single Judge, it was stated based on the written instructions by learned Assistant Government Pleader that the District Collector, Rayachoty, Annamayya District and the Chairperson, District Level Committee, Annamayya District, Rayachoty vide order dated 04.03.2023 directed that the subject property be removed from the prohibited list. In view of the said order the learned Single Judge held that the order dated 10.03.2023 rejecting the appeal was contrary to the order of District Collector and Chairperson, District Level Committee, Annamayya District, Rayachoty dated 04.03.2023 and therefore allowed the writ petition and set aside the order. 6. Learned counsel for the writ appellants submits that after the order dated 04.03.2023, the writ appellants purchased the property from the same owner vide registered sale deed. He submits that from para-4 of 6 the judgment it transpires that the learned Single Judge had set aside the order dated 04.03.2023 and consequently the writ appellants’ rights are being adversely affected, whereas the writ appellants were not a party in the writ petition. 7. We have carefully perused the order of the learned Single Judge, particularly para 4, which shows that the order that has been set aside is the order dated 10.03.2023, and not the order dated 04.03.2023. 8. Para -4 of the impugned order dated 07.03.2026 reads as under: “4. When the said proceedings dated 04.03.2023 are there, the impugned proceedings were issued by the 3rd respondent dated 10.03.2023, contrary to the above said proceedings of the District Collector and the Chairperson, District Level Committee, Annamayya District, Rayachoty dated 04.03.2023. Hence, the same is set aside herewith and accordingly, the respondent Nos.3 and 4 are directed to take up the consequential proceedings, in accordance with law, in terms of the relief sought by the petitioner.” 9. Consequently, the submission advanced by the learned counsel for writ appellants is without force that the order dated 04.03.2023 has been set aside. 10. We are of the view that any of the rights of the writ appellants is not being effected by the impugned order. 11. There appears to be some dispute between the writ petitioner and writ appellants, with respect to the same property. 7 12. In view of the submissions advanced, the case of the writ petitioner appears to be one of an agreement of sale, whereas the case of the writ appellants appears to be of the sale deed from the same person. If it be so, the parties are at liberty to raise their grievance before the appropriate Forum and seek appropriate remedy as per law and as may be advised. 13. With the aforesaid observations, I.A.No.2 of 2026 and the Writ Appeal stands disposed of. No order as to costs.
