GP FOR PANCHAYAT RAJ RURAL DEV The Court made the following O R D E R This Writ Petition has been filed seeking to declare the action of the respondents in taking steps to dispossess the petitioner from the land admeasuring 237 sq. yards and 243.25 sq yards totaling 480.25 sq. yards, situated in S.No.297/1 in Vommangi Village of Prathipadu Mandal, East Godavari District, as illegal and arbitrary, and consequently, to direct the respondents not to dispossess the petitioner from the subject property. SRK, J W.P No.20049 of 2026 2 2. The grievance of the petitioner is that her father was the owner of a house plot in Sy.No.297/1 in Vommangi Village of Prathipadu Mandal, East Godavari District. After his demise, pursuant to the partition, one share each fell to the share of all legal heirs, including the petitioner herein, the daughter of Late Ramisetty Chinna, and one share fell to the mother, i.e., Ramisetty Nagamani. By way of partition, the petitioner got an extent of 237 sq. yards in S.No.297/1. The mother of the petitioner executed a registered gift deed vide document No.5520/2021 dated 18.09.2021 in favour of her sons, namely, Rishibhuvan and Shailiash. Further, the mother of the petitioner executed registered gift deed bearing document No.3849/2026 dated 23.04.2026 with respect to her share admeasuring an extent of 243.25 sq yards in Sy.No.297/1 in Vommangi Village of Prathipadu Mandal, East Godavari District, and delivered the possession of the subject property to the petitioner. Since then, the petitioner has been the absolute owner of the subject property and has been in enjoyment of the same without any interference. 3. It is further grievance of the petitioner that there were disputes between her and respondent No.5. Respondent No.5 bore a grudge against the petitioner in view of the registered gift deed executed by her father in her favour with respect to agricultural land. At the behest of respondent No.3, respondent No.5 is interfering with the possession of the petitioner and taking steps to dispossess the petitioner from the subject land in Sy.No.297/1. The 3rd respondent is also interfering with the possession of the petitioner’s property and obstructed the SRK, J W.P No.20049 of 2026 3 petitioner and her people from clearing the bushes and fencing the extent of her share. It is further alleged that the officials orally directed the petitioner not to enter into the land at the instance of respondent No.5. 4. Sri Y.Koteswara Rao, learned Standing Counsel appearing on behalf of respondent No.3, on instructions, submits that the dispute between the petitioner and respondent No.5 is purely civil in nature. The 3rd respondent herein is not interfering with the said property and no notice has been issued in respect of the subject property. 5. Since the 3rd respondent is not interfering with the subject property, no further orders are necessary. 6. Recording the same, the Writ Petition is disposed of. No order as to costs.
