Mr. Mohd. Imran, learned counsel for the applicant. 2. Mr. Tumul K Nainwal, learned AGA, for the State of Uttarakhand. 3. The present applicant – Raj Kumar @ Ganja S/o Mool Chand, is praying for bail in reference to FIR dated 01.05.2026 bearing FIR No.143 of 2026, Police Station Kichha, District Udham Singh Nagar, which was lodged against unknown person for the offences punishable under Sections 305 (a), 331 (4) and 317 (2) of the BNS, 2023. 4. It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated and the recovery of looted articles as shown are planted one and in fact he has been implicated on the disclosure of his name by the other co-accused. About criminal antecedents, he submits that there is one previous case against the applicant i.e. FIR No.458 of 2024, relates to the offence punishable under Section 8/21 of the NDPS Act, in which he is enlarged on bail and submits that since now the applicant is languishing in jail since 02.05.2026, the applicant be released on bail. 5. On the other side, Mr. Tumul K Nainwal, learned AGA submits that in reference to the criminal antecedents of the present applicant, there is one more case relating to theft i.e. Case Crime No.412 of 2018, which he has not disclosed in the bail application. 6. After hearing the submissions of the learned counsel for the parties and taking into consideration
that the applicant is not named in the FIR and has been implicated on disclosure of his name by the other co-accused and in two previous cases, the applicant is already enlarged on bail, this Court is of the view that the applicant deserves for bail. 7. In such view of the matter, and without expressing any opinion on the merits of the case, the bail application is allowed. 8.
Let the applicant – Raj Kumar @ Ganja, be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount to the satisfaction of the Court concerned, subject to the following conditions:-
“(a) The applicant shall not indulge in any criminal activities after being released on bail. (b) The applicant shall cooperate with the investigation, if any, and after commencement of the trial, he shall join the Trial Court proceedings on each and every date without seeking any unnecessary adjournment. (c) The applicant shall report on the first day of each month to the nearest Police Station and the concerned SHO shall record his presence. He shall also provide the mobile number to the SHO concerned. In breach of any of the conditions as aforesaid the prosecution is free to move an application for cancellation of bail.
