ORDER ON BOARD 25/03/2026
1. This contempt petition has been filed by the petitioner under Article 215 of the Constitution of India under Section 12 of the Contempt of Courts Act, 1971 alleging willful non-compliance of the order dated 04.08.2025 passed by this Court in WP(S) No. 1021/2021.
2. Learned counsel for the petitioner submits that petitioner is challenging the
order passed by the Chief Executive Officer, Janpad Panchayat Mahasamund. The order of the Chief Executive Officer has been quashed and therefore, the respondents are having no other way to grant relief as prayed for by the petitioner as granted in case the case of Sona Sahu Vs. State of Chhattisgarh, in W.A. No. 261 of 2023 decided vide order dated 28.02.2024. In support of contention, he read over para 6 to 8 of the
order.
3. I have heard learned counsel for the petitioner and perused the order subject matter of contempt petition.
4. The operative part of the order dated 04.08.2025 passed in WP (S) No. 1021/2021 is extracted below for ready reference:-
“6. Taking into consideration the decision of the Hon'ble Division Bench in Smt. Sona Sahu (supra), the orders dated 15.01.2021 and 27.01.2021 (Annexure P/1), passed by the Chief Executive Officer, Janpad Panchayat, Bagbhra, District Mahasamund, are hereby quashed.
7. The petitioners are directed to make a fresh representation before the concerned respondent authorities, and same would be considered in the light of the judgment rendered in Smt. Sona Sahu (supra).
8. With the aforesaid observation(s) and direction(s), WPS
No.
1021/2021,
WPS/1884/2021, WPS/1707/2021,
WPS/3337/2021,
and WPS/3338/2021, are allowed & stand disposed of..”
5. Perusal of the above extracted operative portion of the order would show that
3 while quashing the order dated 15.01.2021 and 27.01.2021 (Annexure P/1) therein, the Court has issued a direction to petitioner to make fresh representation to the concerned respondent authorities and the same would be considered in light of the judgment rendered in the case of Smt. Sona Sahu (Supra). The aforementioned portion of the order passed in the writ petition would reveal that the Court has not issued direction granting the relief as prayed by the petitioner but directed to submit representation. Subsequently, the representation submitted by the petitioner was considered by the Director, Directorate of Public Instructions and it was rejected on
19.09.2025. In the operative part of the order, the writ petition number filed by the petitioner is also mentioned as WP (S) No. 1021/2021.

In the aforementioned facts of the case where, the petitioner as of now is an employee of the School Education Department and the Director, Directorate of Public Instructions has considered the representations submitted by the petitioner and had rejected the same, I am of the view that the respondent authority has complied with the direction issued by the Court while considering the representation submitted by the petitioner had rejected the same by detailed order and therefore, I do not find any good ground to proceed further in this contempt petition.
