Petitioners have questioned an order passed under Section 14 of SARFAESI Act by District Magistrate, Haridwar. 4. Learned counsel for petitioners submits that petitioners are ready and willing to repay the entire outstanding dues to the lending institution, therefore the coercive action, which is proposed to be taken against them, may be kept in abeyance for some time. 5. In view of willingness shown by petitioners to repay the loan, the writ petition is disposed of with liberty to them to approach the competent authority in lending institution, by making a representation within 48 hours. Alongwith their representation, petitioners shall deposit rupees one lakh to show their bonafide. Subject to fulfillment of aforesaid condition, petitioner shall be permitted to repay the outstanding dues in two installments, out of which, 40% shall be deposited within fifteen days from date of making representation and the remaining amount shall be repaid within four weeks thereafter. Subject to petitioners abiding the aforesaid condition, the impugned order dated 19.05.2026, shall be kept in abeyance for a period of six weeks. However, in case petitioners fail to deposit rupees one lakh with the competent authority alongwith their representation, then petitioners shall not be entitled to any protection of this order and the respondent authorities shall be at liberty to proceed against them, as per law.
