This writ petition has been filed by the petitioner seeking for following reliefs. “10.1 That, this Hon'ble Court may kindly be pleased to call for records of the case of petitioner. 10.2 That, this Hon'ble Court may kindly be pleased to direct the Family Court, Bilaspur to decide the application of petitioner for visitation right at the earliest in accordance ARPAN SRIVASTAVA Digitally signed by ARPAN SRIVASTAVA Date: 2026.01.20 10:38:58 +0530 2 with law and further be pleased to direct that the petitioner and his mother-father, jointly or separately can visit minor son Liyansh twice in every month on third and fourth Sunday at Bilaspur from 1 pm to 5 pm, without any hindrance of respondent or her family members, till decision of visitation right application of petitioner by the Trail Court, in the interest of justice. 0.3 That, any other relief/order which may deem fit and just in the facts and circumstances of the case.” 2. Learned counsel for the petitioner submits that the petitioner had filed an application under Sections 7 read with Sections 6, 10, and 25 of the Guardians and Wards Act, 1890 before the learned Family Court at Malkajgiri, Telangana. The said application was transferred to the Family Court, Bilaspur, by the Hon’ble Supreme Court vide order dated 4th September, 2023 passed in Transfer Petition (Civil) No. 1549 of 2023. Presently, the application filed by the petitioner is pending consideration before the 2nd Additional Principal Judge, Family Court, Bilaspur, Chhattisgarh, and is registered as CS No. 46- A/2023. Learned counsel submits that the petitioner had filed an application seeking visitation rights with his minor son. The said application was rejected by the learned Family Court vide order dated 01.04.2025, without deciding the matter on merits, on the ground that the main case was required to be decided expeditiously. It is further submitted that the petitioner thereafter filed an application under Order IX Rule 9 CPC, in sum and substance seeking review of the order dated 01.04.2025. The said application, filed on 21.04.2025 and supported by an affidavit, is still pending consideration and has not yet been decided. Learned counsel submits that the sole prayer of the petitioner is for 3 expeditious disposal of the said application by the Family Court. He further submits that visitation rights to meet the minor son are a legal right of the petitioner and that such rights is to be decided by the learned Family Court; therefore, the relief as prayed for deserves to be granted. 3. Taking into consideration the submissions made at the Bar, it is observed that the application filed by the petitioner for review of the order dated 01.04.2025, filed on 21.04.2025, shall be decided by the learned Family Court expeditiously, preferably within a period of two months from the date of receipt of a copy of this order. 4.
