Nongdamba, learned counsel appearing on behalf of the respondents. [2] In view of the limited prayer made on behalf of the petitioner and as agreed to by both the counsel appearing for the parties, the present writ petition as well as the connected miscellaneous application are disposed of at the motion stage itself. [3] The learned counsel appearing for the petitioner submitted that the present writ petition has been filed with a prayer for quashing and setting aside the impugned transfer and posting LAISHRA M DHAKESH ORI DEVI Digitally signed by LAISHRAM DHAKESHORI DEVI Date: 2026.09.02 10:43:32 +05'30' WP(C) NO. 655 OF 2026 MC(WP(C)) NO. 682 OF 2026 2 order dated 04-06-2026 in respect of the present petitioner. It has also been submitted by the learned counsel for the petitioner that the petitioner has already approached the Director General Assam Rifles (DG Sectt.), Laitkor, Shillong (respondent No. 2) by submitting a representation dated 13-08-2026 with a request for cancelling/modifying the impugned transfer and posting order in respect of the petitioner and for allowing her to continue at HQ 22 Sector Assam Rifles, Jwalamukhi on compassionate ground. It has further been submitted by the learned counsel that the said representation is still pending for consideration and disposal by the respondent No. 2. The learned counsel for the petitioner submitted that the petitioner will be satisfied for the time being if the present writ petition is disposed of by directing the respondent No. 2 to consider the said representation on its own merit and strictly in terms of the applicable rules/guidelines and to dispose of the same by issuing a speaking order within a stipulated period. [4] The learned counsel further submitted that pending consideration and disposal of the said representation, a direction may be issued to the respondents to allow the petitioner to continue to WP(C) NO. 655 OF 2026 MC(WP(C)) NO. 682 OF 2026 3 discharge her duties at HQ 22 Sector Assam Rifles, Jwalamukhi wherein she is presently serving. [5] Mr. Kh. Samarjit, learned senior counsel and DSGI appearing for the respondents fairly submitted that as the prayer made on behalf of the petitioner is limited to the consideration and disposal of the representation submitted by her, he has no objection in disposing of the present writ petition as prayed for on behalf of the petitioner. [6] Considering the submission advanced by the learned counsel appearing for the parties and the limited prayer made on behalf of the petitioner, this Court is of the considered view that it will served the interests of justice to issue the following directions :- (i) The Director General Assam Rifles (DG Sectt.), Laitkor, Shillong (respondent No. 2) is hereby directed to consider the aforesaid representation dated 13-08-2026 submitted by the petitioner on its own merit and strictly in terms of the applicable rules/guidelines and to dispose of the same by issuing a speaking order. (ii) The whole process for consideration and disposal of the said representation shall be completed within a period WP(C) NO. 655 OF 2026 MC(WP(C)) NO. 682 OF 2026 4 of 2(two) weeks from the date of receipt of a certified copy of this order. (iii) The respondent No. 2, is further, directed to furnish a copy of the order passed in connection with the said representation to the petitioner within a period of 1(one) week from the date of issuance of such an order. (iv) The respondents are further, directed to allow the petitioner to continue discharging her duties at HQ 22 Sector Assam Rifles, Jwalamukhi, wherein she is presently serving pending consideration and disposal of the said representation. (v) It is made clear that the aforesaid direction has been issued without touching the merit of the writ petition and as agreed to by both the counsel appearing for the parties and that the respondent No. 2 is at liberty to pass any appropriate order in accordance with law.
