JUSTICE M. A. CHOWDHARY, JUDGE. ORDER 27.04.2026 1. Petitioner, through the medium of this petition, has prayed the following reliefs: a. Declare that deemed permission stands accrued in favour of petitioners. b. To modify the status quo order passed by the Special Tribunal Bench-I to the extent it restrains the lawful use and interior work or alternative appeal pending before Bench-I Special Tribunal may kindly be transferred to Bench-II special tribunal. c. Direct the respondents to permit the completion of construction as per the deemed permission including the interior work with further direction to regularize the deviations in terms of new master plan. d. Pass any other order or direction which this Hon’ble Court may deem fit and proper in the interest of justice. 2. Learned counsel for the petitioner submits that the petitioner has filed an appeal before the J&K Special Tribunal, Srinagar against the demolition notice dated 08.08.2025, issued by Srinagar Municipal Corporation, in the month of August, 2025, however, the matter is being delayed by the Tribunal for the reason that the Presiding Officer of Bench No. 1 has remained on leave on most of the appointed dates, causing prejudice to the appellant (petitioner herein). 3. Learned counsel for the petitioner further submits that the petitioner would be satisfied, in case the petition is disposed of, with a direction to the Bench No. 1 of J&K Special Tribunal to decide the matter expeditiously. 4. In view of the submissions made by learned counsel for the petitioner and the limited and innocuous nature of prayer, the present petition is disposed of at this motion stage with a direction to the J&K Special Tribunal to consider and decide the matter expeditiously, preferably, within a period of six weeks. 5.
