This petition is filed by father of the minor children for transfer of G & WC No.9/2024 filed by grandparents for custody on 09.07.2024 pending on the file of Prl.Judge, Family Court, Hassan to the Family Court, Bengaluru. 3. Heard the arguments of learned counsel for petitioner. In spite of service of notice, respondents did not turn up. 4. Learned counsel for the petitioner contended that the ages of the grandparents is 61 and 52 years respectively. The distance between Hassan and Bangalore CORAM: HON'BLE MRS. The petitioner herein is working as Deputy Company Secretary at Bharat Electronics Limited, Bengaluru. Further, the marriage of petitioner was performed with Anupama on 27.10.2017 and they are also blessed with two children one girl by name Charvi Gopal on 10.02.2019 and a son by name Keshab Gopal on 06.11.2020 respectively. During March, 2024, when petitioner went along with his wife to Goa for a trip, there his wife died due to Bronchial Asthma and later disputes arose between the petitioner and his in- laws. But children are residing with the petitioner from 2024 onwards. Initially, the petitioner joined his children in Naguvannahalli School, but the visitation rights were granted to the grandparents to visit the children at every second and fourth Friday of every month during lunch hour in the school, but some disturbance was made by the grandparents and their driver in the school. As such, the school authorities issued transfer certificate to the children. Therefore, the petitioner was compelled to shift the children to BEL Kisora Kendra at Bengaluru and - 4 - HC-KAR NC: 2026:KHC:7335 CP No. 2 of 2026 children are now continuing their education in that place. As the children are residing with him from the beginning and he is taking care of them by joining them in a school and also his parents are with him and the petitioner is taking care of children with the assistance of his parents. Hence, this Court finds that it is just and reasonable to transfer G &WC No.9/2024 filed by the grandparents from the Prl. Judge Family Court, Hassan to the Family Court, Bengaluru. It was also mentioned in the records that respondent No.1 and his son are involved in rowdy activities and criminal cases are pending against them, the details of which are also mentioned.
