IN THE HIGH COURT OF HIMACHAL PRADESH AT SHIMLA
CWP No.6433 of 2026
Decided on 14th May, 2026 Ashish Kumar
…Petitioner Versus State of Himachal Pradesh and others
…Respondents Coram Hon’ble Mr. Justice Ajay Mohan Goel, Judge 1Whether approved for reporting? For the petitioner: Mr. Shivom Vashista, Advocate.
For the respondents: Mr. Rajpal Thakur, Additional
Advocate General.
Ajay Mohan Goel, Judge (Oral)
The petitioner is aggrieved by Annexure P-6, dated 09.02.2026, in terms whereof, the prayer of the petitioner for his posting at some other station on account of adverse family circumstances stands rejected.
2.
Having heard learned counsel for the petitioner and in the light of the fact that the petitioner has been engaged on 07.04.2025 on contract basis as a Lecturer (History), this Court is of the considered view that the petitioner would be well advised to approach the Authority for his adjustment at some
other station after putting him some reasonable period at his present place of posting.
3.
Accordingly, this petition is disposed of with the observation that though this Court is not interfering with the impugned order at this stage, but the petitioner may approach the Authorities afresh after six months and as by then the petitioner would have completed period somewhat nearing two years of service at the present place of posting, at that stage his representation may be sympathetically and favourably considered by the Department.
4.
With these observations, the petition stands disposed of, so also pending miscellaneous applications, if any.
