Petitioner has filed this writ petition seeking following reliefs: “10.1 That, this Hon’ble Court may kindly be pleased to issue suitable writ/direction to the respondent authorities, especially respondent no.2 / Municipal Council, Bhatapara to consider the case of the petitioner for grant of compassionate appointment in light of President-in-Council Digitally signed by PRAVEEN KUMAR SINHA Date: 2026.04.25 10:48:51 +0530 -2- resolution dated 03.07.2025 within stipulated time interval in the interest of justice. 10.2 Any other relief or relief(s) which this Hon'ble Court may think proper in view of the facts and circumstances of the case may also kindly be granted.” 2. Learned counsel for the petitioner submits that petitioner is a adopted child of deceased employee who was working with respondent No.2/Municipal Council. After the death of employee, petitioner has obtained succession certificate from the Court of competent jurisdiction based on the order dated 18.03.2024 (Annexure P-1). Petitioner has also submitted representation before the respondent No.2/Municipal Council and President-in- Council in its meeting dated 03.07.2025 resolved that petitioner can be granted compassionate appointment. However, further steps have not been taken by respondent No.2 in this regard. 3. Learned counsel for respondent No.2/Municipal Council would submit that he has sought instructions and according to his instructions after resolution passed by President-in-Council on 03.07.2025, further order is still to be passed. 4. I have heard learned counsel for the parties and also perused the documents annexed along with writ petition. 5. Considering the facts and circumstances of the case, nature of grievance and further considering that petitioner had submitted representation before respondent No.2 based upon which some resolution has been passed on 03.07.2025 by President-in- -3- Council as stated learned counsel for petitioner, I find it appropriate to dispose of this writ petition at this stage directing respondent No.2 to take further action and pass appropriate order in accordance with law pursuant to resolution dated 03.07.2025 passed by President-in-Council, expeditiously, preferably within a period of 4 months from the date of receipt of copy of this order. 6.
