(2) According to petitioner, he has been dispossessed from the residential accommodation, owned by Waqf Board, under the garb of an order passed in proceedings under Section 138 of Negotiable Instruments Act, while executing a warrant issued under Section 82-83 CrPC. It is contended that petitioner was so dispossessed even after recall of the warrant and petitioner has not been handed over possession of the residential accommodation, due to which he has become homeless. (3) Learned Counsel appearing for Waqf Board, however, submits that petitioner moved an application for modification of order dated 23.3.2026, which was rejected by the concerned Magistrate and petitioner has preferred a revision, which is pending consideration before learned 1st Additional Sessions UKHC010107802026 2026:UHC:5847 Judge, Kashipur, District Udham Singh Nagar. Thus it is contended that petitioner cannot avail two remedies simultaneously.
