1. Mr. Yash Bisht, learned counsel for the applicant.
2. By the instant petition preferred under Section 528 of BNSS 2023, the present applicant Sanjay Bahuguna, S/o Late Shri Durga Prasad Bahuguna is praying for expeditious disposal of proceeding of Complaint Case No. 7503 of 2024, Mr. Sanjay Bahuguna vs. Mr. Dinesh Prasad Bailwal, initiated under Section 138 of Negotiable Instruments Act 1881.
3. It is contended by the learned counsel for the applicant that aforesaid complaint case was instituted in the year 2024 and almost one and half years have been passed but the same has not been expedited so far which is completely against the mandate of Section 143(3) of the N.I. Act.
4. The relief, as sought, for expeditious disposal of the complaint case, as above, appears to be innocuous.
5. In such view of the matter and keeping in view that mandate of Section 143 of the Negotiable Instruments Act, the instant C528 applicant is disposed of finally with the direction to the learned Judicial Magistrate, IInd , Dehradun to expedite the proceedings of Complaint Case No. 7503 of 2024 as early as possible preferably within nine months from the date of production of certified copy

6. It is made clear that the learned Trial Court should keep in mind the mandate of Section 143 of Negotiable Instruments Act while expediting the trial within aforesaid period.
