P.P. 05/ 06.05.2026: Heard learned counsel for the petitioner and learned counsel for the State. 2. The petitioner is apprehending his arrest in connection with Jagannathpur P.S. Case No. 50 of 2025, registered under sections 8(c)/21(b)/21(c)/22(b) and 22(C) of NDPS Act, 1985 and 18(c)/27(b) (ii) of Drugs and Cosmetics Act, 1940, pending in the Court of learned Additional Sessions Judge-II at West Singhbhum, Chaibasa. 3. Learned counsel for the petitioner submits that petitioner happens to be owner of Tata 407 vehicle bearing Registration No. JH-01DW- 1678 and the said vehicle was handed over by the petitioner to his brother Rishi Raj Jaiswal @ Prem Jaiswal and allegations are made of recovery of 3,600/- bottles of Onerex Cough Syrup from the said vehicle. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits that in para 99 of the case diary statement of wife of Prem Jaiswal has been recorded wherein she has stated that the petitioner and Prem Jaiswal are own brother and are doing the business from the same godown and in view that it was within the knowledge of the petitioner that the said vehicle was ( 2026:JHHC:13446 ) being used for what purpose. 5. If a person is the owner of a vehicle or place and unknowingly the said vehicle is being used benefit can be there in the light of Section 25 of NDPS Act to that person. However, in the case in hand, prima facie it appears that it was within the knowledge of the petitioner as wife of Prem Jaiswal who happens to brother of this petitioner has stated that both the brothers were doing the business from the same godown. The quantity of 3,600 bottles Onerex Cough Syrup has been recovered from the said vehicle and the FSL report of said cough syrup has come in para 48 of the supplementary case diary and it has come that the said cough syrup was having codeine phosphate. 6. In the attending facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for bail is hereby rejected.
