JUSTICE SHAMIMA JAHAN ORDER Date : 12.06.2026 Heard Mr. A. Ahmed, learned Counsel for the petitioner and Mr. K.K. Parashar , learned Additional Public Prosecutor for the State. By this application, the petitioners, who are the mother in law and brothers in law of the alleged victim of the FIR have filed the present application for pre- arrest bail in connection with Bhuragaon P.S. Case No. 07/2026 under Section 85/89 of BNS, 2023 R/W Section 3/4 of the Muslim Women (Protection of Rights on Marriage), Act, 2019. It is noticed that the petitioners were enlarged on interim pre-arrest bail by order of this Court dated 26.05.2026 with the condition that the petitioners shall appear before the Investigating Officer within one week from the date of the order and in compliance of the same, the petitioners appeared before the Investigating Officer but it is stated by Mr. K.K. Parashar , learned Additional Public Prosecutor that their statements were not recorded. However, it is seen that the allegations against the petitioners is only to the extent that when the husband had allegedly tortured the wife, they being the relatives of the husband did not object to the same or help the victim. No other allegations as such is reflected against them in the FIR dated 03.03.2026. As such, this Court deems it fit that the interim order dated 26.05.2026 be made absolute with the condition that the petitioners will appear before the Page No.# 3/3 Investigating Officer as and when call for and would cooperate with the investigation.
