By means of this writ petition, petitioner has sought the following reliefs:- “I. issue a order or direction for setting aside the impugned order dated 21-08-2015 and notice dated 2/01/2016 so far as it relates to the land and buildings of the petitioner. II. issue a writ, order or direction in the nature of mandamus directing the respondents to follow the provisions of The Right to fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, for acquisition of land for the purpose of National Highway no. 125, in district-U.S. Nagar. iii. issue a writ, order or direction in the nature of mandamus directing the respondents to give the compensation for acquiring land (Gata no. 1072) of the UKHC010053032018 2026:UHC:5785 petitioner along with interest as per the provisions of The Right to fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.” 6. A counter affidavit is filed by N.S. Nabiyal, Special Land Acquisition Officer, Udham Singh Nagar. In paragraph no. 5 of the said counter affidavit, it is stated that compensation has been awarded, as per law and the amount of compensation has been paid to petitioner in his bank account, detail whereof is indicated in the counter affidavit. 7. Since the amount determined as compensation has been reportedly paid to petitioner, therefore, if petitioner had any grievance against the determination of compensation, then he could have availed such remedy, as is available to him in law. High Court cannot embark upon enquiry for re-determining the amount payable as compensation. 8. The relief as claimed cannot be granted. The writ petition fails and is dismissed.
