This writ petition has been filed by petitioner seeking a writ of mandamus commanding the respondents to give appointment to petitioner in place of his father under the U.P. (Uttarakhand) Recruitment of Dependents of Government Servants Dying in Harness Rules, 1974 (hereinafter to be referred to as ‘the Rules’). 2. From the petition, it is culled out that father of petitioner was working with the Forest Department as a Class IV employee. Father of petitioner expired on 31.12.2014 while still in service leaving behind the petitioner and other family members. At the time of death of his father, petitioner was a minor as his date of birth is 15.08.2006 according to the high school certificate (Annexure No.3 to the petition). Petitioner passed his High School in the year 2021 and Intermediate 1

2026:UHC:5758 in 2023 from the Board of School Education, Uttarakhand. It is after attaining the age of majority, mother of petitioner applied to respondent no.3 on 02.01.2026 along with the application of petitioner (though un-dated) requesting to appoint the petitioner in place of his father under the Rules since he attained the age of majority. 3. It is contended by learned Senior Advocate for petitioner that the application dated 02.01.2026 has not been considered and it is lying un-decided by respondent no.3 till date. He further submits that if the respondent- Department is directed to decide the said application in a time bound manner, justice would be done to the petitioner. 4. Learned State Counsel has no objection if such an order is passed by this Court. 5.
Accordingly, the writ petition is disposed of directing respondent no.3-Divisional Forest Officer, Garhwal Forest Division, Pauri, District Pauri Garhwal to decide the application moved by mother of petitioner dated 02.01.2026, accompanied by un-dated application of petitioner, seeking appointment under the Rules within eight weeks from the date of production of a certified copy of this order strictly in accordance with law; and if found complete in every respect, petitioner may be considered for giving appointment on a post in accordance with his educational qualification. 6.
