BEFORE HONOURABLE MR. JUSTICE RAJESH MAZUMDAR ORDER 12.06.2026 Heard Mr. M. Biswas, learned counsel for the petitioner. Also heard Mr. R.R. Kaushik, learned APP for the State. 2. This is an application has been filed under Section 483 of the BNSS, 2023, praying for granting of bail to the petitioner, namely, Lamneao Kipgen @
Page No.# 2/3 Tingneilam, who is in custody since 14.04.2026 in connection with Basistha PS Case No. 118/2026 under Section 21(b) of the NDPS Act, 1985. 3. The learned counsel for the petitioner has submitted that the petitioner has been in incarceration for 60 days as of today. 4. The learned APP has submitted that the quantity recovered from the accused/petitioner is of intermediate quantity. It has further been submitted that the forensic report was received yesterday and therefore, the charge-sheet would be submitted at the earliest possible time. 5. However, in view of the submissions made, the length of incarceration undergone by the petitioner, the quantity involved and the fact that the charge- sheet has not yet been submitted, this Court is inclined to grant the privilege of bail to the petitioner. 6. Accordingly, the petitioner, namely, Lamneao Kipgen @ Tingneilam is enlarged on bail on furnishing a bond of Rs. 20,000/- with 2 (two) sureties of the like amount to the satisfaction of the learned CJM, Kamrup (M), subject to the following conditions:- i. the petitioner shall appear before the Investigation Officer of said Basistha Police Station Case No. 118/2026 as and when he is required for necessary investigation;
Page No.# 3/3 ii. the petitioner shall not leave the territorial jurisdiction of Basistha Police Station, without obtaining prior written permission from the concerned Investigation Officer of the case; iii. the petitioner shall not hamper with the investigation, or tamper with the evidence of the case; iv.
the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any Police Officer; and v. the petitioner shall not involve himself in any criminal activities in future. 7. In case of any violation of the aforesaid terms and conditions by the petitioner, the bail granted to him in the aforesaid Basistha Police Station Case No. 118/2026 shall stand liable to be revoked. 8.
