2. This is an application u/s 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 for granting pre-arrest bail to the accused/petitioner, namely, Eeshankur Saikia in connection with Changsari P.S. Case No. 45/2026 u/s 406/420/469/471/120B/506/191/193 of IPC.
3. Case Diary received. Perused the same.
4. It is submitted by Mr. Hussain that in pursuant to the order of interim pre- arrest bail he has appeared before the I/O and cooperated in the investigation of this case. He is still ready and willing to extend his cooperation in further investigation of the case, if he is granted with the privilege of pre-arrest bail. He further submitted that from the contents of the FIR it is apparent that the case is civil in nature but it has given a criminal colour.
5. Ms. Borah, the learned Addl. PP submitted that there are some incriminating materials in the Case Diary and in this regard the petitioner had already appeared before the I/O and cooperated in the investigation.
6. Considering the submissions made by learned counsels for both sides, perusing the Case Diary and other aspects of the case, this Court is of the opinion that the petitioner is entitled for pre-arrest bail.
7. Hence, the order of interim pre-arrest bail dated 11.05.2026 is hereby made absolute under the same terms and conditions.
8. The anticipatory bail application is disposed of.
