Kausik (Allowed) CRM (NDPS) 654 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with NCB Crime No. 07 of 2025 dated 10.04.2025 under section 8(c) to be read with section 20(b)(ii)(c)/25/27A/29/35/54 of the NDPS Act, 1985. And In the matter of : Jahidul Sk @ Jaidul Sk ……Petitioner. Ms. Saba Parween ……for the applicant. Mr. Rajdeep Majumder, Ld. DSGI, Sr. Adv. Ms. Arushi Rathore ……for the UOI (NCB). Learned advocate appearing for the petitioner submits that petitioner is in custody for a year and the subject matter of the case relate to alleged recovery of 20.800 Kgs. of Ganja. Learned DSGI appearing on behalf of the NCB opposes the prayer for bail and submits that charges have already been framed and the petitioner has two criminal cases against him. Having considered that the petitioner is in custody for more than a year and out of 10 witnesses only 1 witness has been examined, I am of the view that there is no possibility of the trial being taken to its logical conclusion very soon. 2 Accordingly, I am inclined to release the petitioner on bail. Accordingly, Petitioner, namely, Jahidul Sk @ Jaidul Sk shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Court under NDPS Act, City Sessions Court, Kolkata. If on bail, petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Kolkata without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 654 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
