The case of the petitioners is that, the petitioners initially joined in service in A.P.G.E.N.C.O. in the year 2016 under direct recruitment as a security guard and re-designated as A.P.G.E.N.C.O. constables vide orders issued in G.O.O.No.446/JS(Per)/2016, dated 10.03.2016. At the time of issuing appointment orders, a condition was imposed under Clause 4(d), stating that the post of security guard is in essential uniformed services of A.P.G.E.N.C.O. and therefore the candidates appointed in uniformed services shall not be permitted to convert other services of A.P.G.E.N.C.O. for a period of 10 years. In view of the same, the cases of the petitioners were not considered. Aggrieved by the same, the petitioners approached this Court in the above said Writ Petition. 3. Learned counsel for the petitioners contends that the petitioners possess all requisite qualifications for the purpose of appointments by transfer as Junior Assistants in Accounts Service from the A.P.G.E.N.C.O. constable. Learned counsel for the petitioners draws the attention of this Court to a similar situation, wherein when the petitioners therein applied for the examination for appointment by transfer to the post of Junior Engineer and the same was rejected. The said rejection order was challenged before the Hon’ble Division Bench of this Court in W.A.Nos.854, 855 of 2022 and the Division Bench was pleased to allow the petitioners therein to appear for the examination. He further submits that basing on the above said judgments, a coordinate Bench of this Court had granted interim order dated 06.09.2023, directing the respondents to permit the petitioners therein to appear for written examination. Accordingly, they appeared for the written examination held on 09.09.2023. However, the results were kept in sealed cover. 4. Upon considering the factual aspects and submissions of both the learned counsel, on perusing the material on record, this Court is of the view that the condition imposed in the order of appointments is that the uniform services of Security Guard will not be permitted to convert into other service of A.P.G.E.N.C.O. for a period of ten years. Since the appointments were made on 10.03.2016, and the ten years period has now been elapsed, this Court is of the opinion that the petitioners are entitled to be considered for conversion of their services from A.P.G.E.N.C.O. Security Guards/Constables to the post of Junior Assistant in the Accounts Service, in accordance with the applicable rules and regulations. 5. Accordingly, this Writ Petition is disposed of. The respondents are directed to open the sealed cover and declare the results of the petitioners and consider their cases for conversion, if they are otherwise eligible, within a period of two (02) months, from the date of receipt of a copy of this order. No costs. Consequently, miscellaneous petitions if any, shall stand closed.
