1. This bail application has been filed on behalf of the petitioner under Section 483 of B.N.S.S. in connection with FIR No. 221/2020 registered at Police Station Badi Sadar, District Dholpur for offences under Sections 147, 148, 149, 332, 353, 307, 400, 216-A of IPC, under Sections 3, 25 of Arms Act and under Section 11 of The Rajasthan Dacoity Affected Areas Act.

Learned counsel for the petitioner submits that the present matter pertains to bail jump. After getting benefit of bail, the petitioner went out of State for earning livelihood, therefore, he could not appear before the learned Trial Court on the concerned date and as such on 01.07.2024, his bail bonds were forfeited.
Learned counsel further submits that the petitioner is in judicial custody since 08.04.2026. Learned counsel also undertakes that the petitioner shall appear before the learned Trial Court on each
[2026:RJ-JP:21454] (2 of 3) [CRLMB-7838/2026] and every date as fixed by the Court and the petitioner shall not make any attempt to jump the bail again, therefore, in the interest of justice, the bail application of the petitioner may be allowed. 3. Per contra, learned Public Prosecutor vehemently opposes the bail application. 4. Taking into consideration the overall facts and circumstances of the case; the arguments advanced by learned counsel for the petitioner, as also the undertaking of the learned counsel on behalf of the petitioner that henceforth the petitioner shall appear on each and every date as fixed by the learned Trial Court, without expressing any opinion on merits/demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail. 5. Therefore, this bail application under Section 483 of BNSS is allowed and accused-petitioner Naresh S/o Shri Ramdal is ordered to be released on bail provided he furnishes a personal bond in the sum of Rs. 1,00,000/- with two sureties of Rs. 50,000/- each, out of whom one surety should be a close relative of the petitioner, to the satisfaction of the Trial Court. He shall appear before the concerned Court on all subsequent dates of hearing and as and when called upon to do so. 6. However, it is made clear that the petitioner shall not involve himself in any other offence(s) during currency of bail granted by this Court. The petitioner is further directed to mark his presence in the concerned police station in 1st week of every month, till trial is concluded. [2026:RJ-JP:21454] (3 of 3) [CRLMB-7838/2026]
7. If breach of any of these conditions is reported or come to the notice of the Court, the same shall alone be a reason for the Trial Court to cancel the bail granted to petitioner by this Court. 8. It is made clear that in case of further misuse of liberty of bail, subsequent prayer of bail on behalf of the petitioner shall not be considered. 9. The observation made hereinabove is only for decision of the instant bail application and would not have any impact on the trial of the case in any manner. 10.
