G.P. for Agriculture The Court made the following: 2 W.P.No.9146 of 2026 ORDER: The writ petition is filed under Article 226 of the Constitution of India to issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the inaction of the respondent No.3 in considering and disposing the petitioner’s representation dated 02.03.2026 and grant continuation / extension of the cleaning contract as per the provision in Clause 6 of the lease agreement dated 01.04.2024. 2. The case of the petitioner, briefly stated, is as follows: The petitioner is a registered society, formed with object of providing labour contract services, particularly sanitation works in various government departments, public institutions. Over the last six years from 2020-2026, the petitioner has been providing services to the Madanapalle Market Yard by entering into a contract with it and rendered services with utmost dedication and efficiency to the satisfaction of the respondents. Condition No.6 of the lease agreement dated 01.04.2024 permits extension of the contract by two more years, if the work performed is satisfactory. Therefore, the petitioner submitted a representation dated 02.03.2026 seeking extension of contract by two years. Due to inaction of the respondents in considering the representation, this writ petition was filed. 3. Ms.T.Sreesha, learned counsel representing the learned counsel for the petitioner, requested to pass appropriate order as the representation is pending for consideration before the respondents. 4. Sri G.Rajeswara Rao, learned Standing Counsel for A.M.C. placed on record a copy of written instructions of the Secretary, Agricultural Market Committee, Madanapalle, dated 13.04.2026 and submitted that as per condition No.3 of the lease if any trader, farmer or market yard employee complaints about the unsatisfactory services of 3 W.P.No.9146 of 2026 the petitioner, the contract needs to be cancelled without any intimation to the petitioner and that the committee decided not to extend the lease for any further period and decided to call for a new application through e-tender and therefore, the petitioner may participate in the proposed e- tender. He further submitted that as per the written instructions, there was no complaint received against the petitioner. He further stated that representation has not been so far disposed. 5. In view of the submissions on both sides, in the absence of any complaint as per condition No.3 of the contract, there is no bar in considering the representation of the petitioner as it is purely a discretion. 6. Accordingly, the writ petition is disposed of directing the respondents to consider the representation of the petitioner dated 02.03.2026 and pass appropriate order within ten (10) days from the date of receipt of copy of this order.
