On prayer of the petitioners, liberty is granted to correct the nomenclature of the 3rd respondent in the cause title of the application. Affidavit of service filed by the petitioners is taken on record. None appears for the Panchayat despite service. The petitioners allege that the private respondents have constructed six buildings in the plot in question without obtaining any sanctioned plan. The petitioners submitted a representation before the concerned authority on 23rd February, 2026 in this regard which is yet to be considered. The petitioners seek consideration of the same. Learned counsel for the private respondents denies and disputes the submission made on behalf of the petitioners and submits that the private respondents have filed a writ petition against the petitioners alleging
2 unauthorised construction raised by them in a separate plot. Be that as it may, since the representation submitted by the petitioners is pending before the authority, the District Engineer, Howrah Zilla Parishad, being the 3rd respondent herein, is directed to consider and dispose of the representation within six weeks from the date of communication of the order upon affording reasonable opportunity of hearing to all concerned including the petitioner and the private respondents, in accordance with law. The decision taken by the authority shall be communicated to the petitioners within a week thereof. The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
