1. Petitioner has filed this petition seeking following reliefs:-
“10.1. It is therefore prayed that, this Hon’ble Court may kindly be pleased to call for the entire records pertaining to the case of the petitioner. 10.2. That this Hon’ble Court may kindly be pleased to issue a writ/order/direction in nature of mandamus whereby to set aside/quash the impugned Order dated 26.12.2025 issued by the Respondent – Joint Director, National Health Mission, Raipur as well as petitioner’s Annual Performance Appraisal Report of year 2024-25 and direct to the Respondent Authorities to reinstate the petitioner with back wages and consequential benefits within stipulated time. 10.3. That any other relief/reliefs, which this Hon’ble Court may think fit and proper in the facts and circumstances of the case, with cost of the petition, may also please be granted to the petitioner.”

Learned counsel for petitioner submits that respondent No.3 vide order dated 26.4.2021 (Annexure P-3) appointed the petitioner as District Manager-Account (NHM) on contract basis and since then petitioner has continuously worked with dedication and honesty. Upon surfing the portal, petitioner came to know that in the comment column No.9 of his Annual Performance Appraisal Report, it is mentioned that “work performance is unsatisfied” and immediately thereafter, according to guidelines, petitioner submitted representation before Secretary, Public Health and Family Welfare Department,
3 Raipur on 12.1.02025. However, till date appeal/representation submitted by petitioner has not been considered and decided. He contended that after the end of year 2025, petitioner was discontinued from services without waiting for decision on his appeal/representation and therefore, action on the part of the respondent No.3 is arbitrary. He further submits that as appeal/representation of petitioner is still pending consideration, a direction be issued to respondent No.1 to take decision on representation submitted by petitioner expeditiously and till then respondent No.3 be directed not to fill up the post on which petitioner was working. 3. Learned counsel for respective respondents would submit that in view of limited prayer made by learned counsel for petitioner with regard to taking decision on appeal/representation, they are having no objection. 4.
On due consideration of submission of learned counsel for respective parties, considering the fact that petitioner was initially engaged in the year 2021 and he continued till December 2025; after getting knowledge about adverse entry in Annual Performance Appraisal Report, petitioner has already submitted appeal/representation before respondent No.1 as early as on 12.10.2025, which is still undecided, this writ petition is disposed of with a direction to respondent No.1 to take decision on appeal/ representation of petitioner dated 12.10.2025 in accordance with law expeditiously, preferably
4 within a period of three weeks from the date of receipt of the
order.
5. Till the decision is taken on appeal/representation of petitioner, respondent No.3 shall not fill-up the post on which the petitioner was working.
