Learned counsel for the petitioner submits that the only material available against the present petitioner is the statement of a co-accused. However, the bail application of the arrested accused from whom recovery was made, has been turned down by this Court.
Learned counsel for the State strongly opposes the prayer for anticipatory bail, relies on the orders passed by the Coordinate Bench dealing with the facts and the statements of a porter who was asked to load the goods and submits that he had seen the present petitioner with one of the co-accused, who was present during the entire process, but could not be apprehended. Within the two persons apprehended in the process, the one who was driving the car was granted bail and the other is still in custody. The petitioner, if apprehended, could be identified by the witnesses. Moreover, there is a criminal antecedent against
2 the present petitioner being Raninagar PS Case No.588 of 2017 under Sections 21(c)/29 of the NDPS Act. At this stage, learned counsel for the petitioner submits that in the old matter, the petitioner had got acquitted. Considering the above, the other materials available in the case diary and in view of the restrictions contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail.
The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities. [ (Jay Sengupta, J.)
