GP FOR REGISTRATION AND STAMPS The Court made the following: 6 THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO WRIT PETITION No.12451 OF 2025 ORDER: The present Writ Petition is filed challenging the inaction of respondent Nos.2 to 4 in considering and acting upon the petitioner’s representations dated 04.01.2024, 19.12.2024 and 01.03.2025, which were submitted seeking to de-notify the land admeasuring Ac.2.68 cents in Sy.Nos.189/1,3,4 & 5 situated at Phoolbagh, BIT-II, Vizianagaram, from the prohibited property list notified under Section 22A(1)(c) of the Registration Act, 1908. 2. Heard learned counsel for the petitioners and learned counsel appearing on behalf of the respondents. 3. It is asserted in the representations that an extent of Ac.5.28 cents in Sy.No.189/1 to 5 belongs to Botta Appala Swamy, who purchased the same through registered sale deed. Subsequently, sub-division has taken place in Sy.No.189 and the land admeasuring Ac.2.60 cents was de-notified from the prohibited property list and converted into a layout in the year 1975. As per the information furnished under the RTI Act, vide proceedings dated 05.03.2025, the layout was approved under L.P.No.60/87 by the Visakhapatnam Metropolitan Region Development Authority, Visakhapatnam. 4. As the prayer in the Writ Petition is only to direct the respondents to consider the petitioners’ representation, the Writ Petition is disposed of, without expressing any opinion on merits of the matter, directing the 7 concerned respondent to examine the petitioner’s representation dated 01.03.2025, and pass appropriate orders in accordance with law, and communicate the decision to the petitioners within a period of two months from the date of receipt of a copy of this order. There shall be no order as to costs.
