2. Mr. Sandeep Sharma, learned AGA for the State.
3. Present applicant-Shashibala, W/o Jagat Singh is praying for bail in reference to a First Information Report dated 07.06.2026 bearing FIR No.0157 of 2026, P.S. I.I.T, District Udham Singh Nagar wherein she has been implicated for the offences punishable under Section 8/20 of N.D.P.S. Act.

It is argued by learned counsel for the applicant that present applicant is innocent and has been falsely implicated; the alleged contraband, charas, which is shown to be recovered, is much below the commercial quantity i.e. 244 grams and there is no substantial compliance of the provision of the NDPS Act. She further argued that the applicant has the criminal antecedents of two cases bearing Case Crime No.039 of 2019 and Case Crime No.1361 of 2019 that too relates to the 60 Excise Act in which she has been already enlarged on bail.
5. On the other hand, learned AGA has not disputed about the quantity of the contraband, which is shown to be recovered from the present applicant, which is, admittedly much below the
commercial quantity and has also not disputed about the criminal antecedents.
6. After hearing the rival submissions of
learned counsel for the parties and taking into
consideration that the present applicant is a lady and the alleged contraband, which is shown to be recovered, is only 244 gram of charas and in other two previous cases, applicant has already been enlarged on bail, this court is of the view the applicant deserves for bail.
7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed.
8. Let the applicant-Shashibala be released on bail on her executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
