27.02.2026 Serial no. 24 [G.S.D] CRM 12639 of 2017 Ref: An Application for Cancellation of Bail In the matter of : Janab Anis Pailan @ Anish Pailan … Petitioner(s) Mr. Partha Pratim Das … for the State The records of the case reflect that there was a direction for filing Affidavit-in-opposition and Affidavit-in-reply. However, the records do not reflect such affidavits were exchanged. The subject-matter of the case relates to an order dated 16.10.2017 granting bail to the o.p. no.2 by the learned Vacation Judge at Alipore in connection with Bishnupur PS Case No. 508 of 2017. More than eight years have passed since such order of bail was granted. Having considered the time period which has passed in the meantime, I am of the view that it would not be wise to interfere, at this belated stage. However, if the applicant is of the opinion that the o.p. no.2 has misused the liberty and if there are any supervening circumstances creating impediment in the progress of the case, in such circumstances, the petitioner would be at liberty to prefer an application under the changed circumstances which the learned jurisdictional court would consider by exercising its discretion. 2 At this stage, there is no scope for interference. With the aforesaid observations, CRM 12639 of 2017 is dismissed. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
