W.P.(C) No. 11816 of 2026
K. Rama Krishna
….
Petitioner Mr. S.K. Nayak, Advocate
-versus-
Union of India & Ors.
….
Opposite Parties Mr. P.K. Parhi, DSGI along with Mr. R. Behera, CGC
CORAM:
JUSTICE BIRAJA PRASANNA SATAPATHY
Order No.
ORDER 22.04.2026
01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode.
2. Heard learned counsel appearing for the Parties.
3. Even though the present Writ Petition has been filed inter alia with the prayer to direct the Opposite Parties not to proceed with the disciplinary proceeding basing on the pendency of a criminal proceeding in SC- NDPS Case No.528 of 2025 in the file of learned District Judge, Visakhapatnam-3, but on instruction Mr. P.K. Parhi, learned DSGI contended that Petitioner is not an accused in the aforesaid criminal proceeding. Instruction provided by the learned DSGI reads as follows:-
“Not an Accused:- Shri K. Rama Krishna is not an accused in the criminal case (SC NDPS) Case No.528 / 2025). The criminal proceeding is directed against the person apprehended with contraband (Shri Ahammed Haji), whereas the departmental inquiry against the petitioner is purely an administrative matter concerning his professional misconduct and procedural lapses in handling that custody.”
4. Having heard learned counsel appearing for the Parties, considering the submissions made and since it is found from the instruction that Petitioner is not as accused in the criminal proceeding, the prayer as made in the Writ Petition as per the considered view of this Court is completely misconceived and not entertainable.
5. Accordingly, the Writ Petition stands dismissed.
