The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 113/2025, registered at Police Station – Bamhnidih, District – Janjgir-Champa (C.G.) for the offence punishable under Sections 296, 351(3), 109 of Bharatiya Nyaya Sanhita, 2023 and Sections 25 and 27 of Arms Act. 2. As per the prosecution story, in brief, is that the complainant, Niraj Soni, appeared at the police station and filed a report stating that on December 3, 2025, at around 1:20 pm, he. Shivam Soni, and Shiva Soni were visiting the Satbahiniya Temple at Bamhanidih. While standing there and PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.02.05 12:13:45 +0530 2 talking, the applicant Jageshwar Mahant, a resident of Rohda, arrived from the direction of the liquor distillery and started using abusive language, insulting their mother and sister. When they objected, he threatened to kill them and, with the intention to murder, stabbed Shiva Soni in the left abdomen with a sharp knife he was carrying. The knife penetrated Shiva Soni's abdomen, causing serious injuries. When the complainant and Shivam Soni tried to intervene, the applicant also stabbed Shivam Soni in the left hand with the knife. causing serious injuries. The injured were taken to the Bamhanidih Government Hospital and later referred to Janjgir District Hospital. Based on the complainant's report, a case was registered under Sections 296, 351(3) and 109 of BNS against the applicant, and the investigation was initiated. The accused/applicant was located, arrested, and his statement was recorded wherein he confessed to the crime. The knife used in the incident and the clothes worn by the accused were seized, and he was duly arrested. After completion of investigation charge sheet has been filed under Sections 296, 351(3), 109 of BNS and Sections 25 & 27 of the Arms Act. 3. Learned counsel for the applicant has argued that the applicant is innocent and has been falsely implicated in this case. He further submitted that the applicant is in jail since 04.12.2025. The applicant has no previous criminal antecedents, the charge-sheet has been submitted. As the trial is likely to take a considerable time for its conclusion, learned counsel prays for grant of bail. 4. On the other hand, the learned State counsel opposed the bail application and submitted that the charge-sheet has been filed in the present case. He further submits that there are two injured persons and the applicant assaulted them with a knife. One of the injured, namely Shiva Soni, 3 suffered a lacerated wound in the lumbar region with part of the intestine protruding out. 5. I have heard learned counsel for the parties and perused the documents available on record. 6. Taking into consideration the facts and circumstances of the case, nature and gravity of allegation levelled against the applicant and the fact that there are two injured persons and the applicant assaulted them with a knife, one of the injured, namely Shiva Soni, suffered a lacerated wound in the lumbar region with part of the intestine protruding out, further the charge-sheet has been filed and he is in jail since 04.12.2025 and conclusion of the trial is likely to take some time, hence, this Court is of the opinion that this is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of the applicant - Jageshwar Das Mahant @ Raja involved in Crime No. 113/2025, registered at Police Station – Bamhnidih, District – Janjgir-Champa (C.G.) for the offence punishable under Sections 296, 351(3), 109 of Bharatiya Nyaya Sanhita, 2023 and Sections 25 and 27 of Arms Act, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
