Mr. T.A. Khan, learned Senior Counsle appearing for the petitioner. 2. Mr. Devendra Pant, learned Standing Counsel for the State of Uttarakhand. 3. By means of this writ petition, petitioner has sought the following reliefs:- (i) To issue a writ, order or direction in the nature of mandamus commanding the respondents no. 1 and 2 not to permit the respondents no. 3 to 6 to run any school on the land of the petitioner bearing khasra no. 123, 124 (New No. 192), Khata No. 26, situated at Village Talli Haldwani, Tehsil Haldwani, District Nainital and the respondents no. 1 and 2 may also be restrained from granting any further permission to the respondents no. 3 to 6 to run any school on the aforesaid land. (ii) To issue a writ, order or direction in the nature of mandamus commanding the respondents no. 1 and 2 to cancel the recognition granted to the school of the respondent no. 3 to 6, which is being run on the land bearing khasra no. 123, 124 (New No. 192), Khata No. 26, situated at Village Talli Haldwani, Tehsil Haldwani, District Nainital, in the name and style of Sonrisa Public School. 4. According to petitioner, respondent UKHC010117032026 2026:UHC:5760 no. 6/school, is being run on petitioner’s land without his permission and the Authorities of Education Department have turned blind eye to the said fact despite representations. 5. Learned State Counsel, however, submits that it is private dispute and a civil suit is pending between petitioner and private respondents, who are running the school. He submits that petitioner is now trying to open a new front against the respondents by filing this writ petition. 6. This Court finds substance in the submission made by learned State Counsel. Since a civil dispute is going on between petitioner and private respondents, therefore, all issues, pertaining to school in question, have to be resolved in the pending civil suit. 7. The relief, as claimed by the petitioner, therefore, cannot be granted. Accordingly, the writ petition fails and is dismissed.
