The petitioner has filed this petition seeking following relief :- 10.1 That, this Hon'ble Court may kindly be pleased to set aside the impugned order dated 27.03.2019 (Annexure P/1) passed by the respondent no.3, Government College, Dipika on account of loss of books during the service tenure of the petitioner in the interest of justice. Mr. Sudeep Agrawal would submit that at the relevant time, the petitioner was posted to the post of Assistant Professor (Hindi) in Government College, Dipika, District Korba. She was transferred vide order dated 01.10.2018 from Government College, Dipika, Korba to Minimata Girls College, Korba. He would submit that the petitioner was directed to handover the charge of Library to the respondent No. 3. It is contended that after transfer, Last Pay Certificate (LPC) was not transferred to the said institution and an order of recovery was issued vide order dated 27.03.2019 by the respondent No. 3 without affording any opportunity of hearing. He would submit that during the pendency of this petition LPC has been issued; therefore, the petitioner would not press relief in this regard. He would submit that with regard to recovery, no opportunity of hearing was afforded; therefore, a direction may be issued to the respondent authorities to take action, if any, after affording due opportunity of hearing. 3. Mr. Anil Pandey, Government Advocate appearing for the State would oppose. 4. Taking into consideration the prayer made by Mr. Agrawal, this petition is disposed of with a direction to the respondent authorities, if any recovery proceeding, pursuant to letter dated 27.03.2019 (Annexure P/1), is initiated against the petitioner, sufficient opportunity would be afforded to the petitioner. 3 5.
