(2) Petitioner has sought following reliefs in this writ petition: “(i) Issue a writ, order or direction commanding the Respondent No. 1 – University to include the newly added courses i.e. B.C.A. and B.BA with approved intake of 60 seats each in the SAMARTH PORTAL for the academic session 2026-27, along with the existing courses of B.H.M. and B.Sc. Agriculture, for which the Petitioner-Institute has already been granted temporary affiliation by the Respondent- University and approval from the esteemed office of The Chancellor, in the interest of justice. And/or; (ii) Issue writ, order or direction commanding the Respondent-University to decide the representations dated 05.06.2026, 23.06.2026 and 25.06.2026 (Annexure No. 6 at Pages 33-40) submitted by the Petitioner-Institute, in the present circumstances of the case.” (3) According to petitioner, it is conducting B.H.M. and B.Sc. Agriculture courses for the last several years and this year, it intended to introduce two new courses, namely, B.B.A. and B.C.A., for which it made an application to Soban UKHC010120112026 2026:UHC:5848 Singh Jeena University for affiliation and the application was forwarded by the University to the O/o Chancellor. It is contended that the official website of Chancellor’s Secretariat indicates that the application filed by petitioner for grant of affiliation to the new courses was approved by the Chancellor, however the new courses are not being included in the SAMARTH Portal. (4) Page 30 is the photocopy of the screenshot of the official website of the Chancellor’s Secretariat, which prima facie supports the contention raised on behalf of the petitioner. (5) Having regard to the facts of the case, writ petition is disposed of with a direction to the competent authority in the University to grant provisional affiliation to petitioner for B.B.A. and B.C.A. courses, if Chancellor has granted approval for affiliating those two courses, as is indicated from the screenshot of the website of Chancellor’s Secretariat. However, it is made clear that if it is later found that the statement made on behalf of petitioner that His Excellency The Chancellor has approved affiliation to new courses was incorrect, then the provisional affiliation granted to the petitioner shall stand cancelled and University shall be at liberty to impose heavy fine upon the petitioner.
