Learned advocate appearing for the petitioner submits that the petitioner is in custody for 2 years 2 months and the principal eyewitness being the son has turned hostile. There are no materials to connect the petitioner with the offence, as such, the petitioner may be released on bail.
Learned advocate for the State opposes the prayer for bail and submits that 13 witnesses have been examined and 7 more witnesses are left.
Having considered the stage of the case as also the post- mortem report, at this stage, I am not inclined to release the petitioner on bail. However, as a matter of last chance, I direct the learned trial court to complete the prosecution witnesses within a period of six months. In case in spite of co-operation extended by the petitioner the evidence of the witnesses are not concluded,
2 learned trial court would exercise its discretion for releasing the petitioner on bail after the aforesaid period is over. At this stage, the prayer for bail of the petitioner is rejected.
With the aforesaid directions, CRM(M)495 of 2026 is
disposed of.
