For the reasons mentioned in the application, the same is allowed and the delay of 18 days is hereby condoned. 3. Heard on the restoration application. 4. Learned counsel for the petitioner submits that on 16.12.2024, due to inadvertent circumstances, counsel for the appellant could not remain present before the Court to pursue the matter and, therefore, the matter came to be dismissed in default. He further submits that otherwise the appellant has been pursuing the appeal diligently. 5. For the reasons mentioned in the restoration application, the same is allowed, subject to payment of costs of Rs. 2,000/- to be [2026:RJ-JP:20330] (2 of 2) [CRES-51/2025] deposited with the Rajasthan Legal Services Authority within a period of four weeks. 6. If the aforesaid amount is deposited within four weeks and the receipt thereof is filed before the Registry, S.B. Civil Misc. Appeal No. 3647/2009 shall stand restored to its original number. 7.
