By means of present writ petition, petitioner has challenged the order dated 30.06.2026 whereby the petitioner, whose name finds place at Serial No.3 of the order, has been transferred from Haldwani to Bageshwar. 5. The main ground of challenging the transfer order, as canvassed by learned Counsel for the petitioner, is that the petitioner is though suffering from various ailments viz. Prostrate, Fistula, Bladder-neek- obstruction, even he has recently been operated on 04.06.2026 for Fistula, he has been transferred to such a distant place. He further submits that his case falls under Section 3(d) of the Uttarakhand Annual Transfer for Public Servants Act, 2017 (hereinafter to be referred to as “the Act”) and is covered under the phrase in that Section “any such disease for which State Medical Board does not recommend for posting in any particular place/area and the Committee constituted under Section 27 of the Act has given its approval thereon”. UKHC010120152026 6. From a perusal of the record, only this much is reflected that the petitioner is operated for Fistula on 04.06.2026. The case of petitioner does not fall in the category of ‘serious patient’ under Section 3(d) of the Act as there is no document annexed with the writ petition that the State Medical Board had ever recommended for not posting the petitioner in any particular place/area. In such view of the matter, petitioner’s case does not call for any interference so far as impugned order is concerned. 7. However, a limited relief is granted to the petitioner by giving a liberty to him to move a fresh representation to respondent no.3 within seven days from today ventilating his grievance; if such a representation is so moved, respondent no.3 shall take decision thereon within seven days thereafter sympathetically and in accordance with law. 8. The writ petition stands disposed of accordingly.
