The petitioner is apprehending his arrest in connection with Complaint (Excise) Case No. 851 of 2021, registered for the offence under Sections 47(a)/55 of the Excise Act, pending in the court of learned Judicial Magistrate, 1st Class, Giridih. 3. Learned counsel appearing for the petitioner submits that the allegations are made of recovery of the foreign liquor from the house of the petitioner, however, in the seizure list, there is no independent witness and only the police officials have signed on the seizure list. He next submits that even the family member’s signatures are not there. He also submits that the petitioner is having no criminal antecedent as disclosed in para 13 of the petition. 4. Learned counsel appearing for the State has opposed the prayer and submits that from the house of the petitioner, liquor has been recovered. 5. Considering that in the seizure list, there is no independent witness and petitioner is having no criminal antecedent as disclosed in para 13 of the petition and in that view of the matter, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within two weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Giridih, in connection with Complaint (Excise) Case No. 851 of 2021, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
