Mr. Raj Awasthi, learned counsel appearing for the applicant/insurer would submit that the learned Claims Tribunal fastened liability with the owner-cum-driver of the offending vehicle as there was breach of policy conditions. He would contend that due to inadvertence in paragraph no. 9 of final judgment passed in MAC No. 671 of 2021 dated 06.01.2026 , it is observed that “insurance company” is directed to pay the enhanced compensation of Rs.53,800/- with interest @ 9% per annum to the claimant within a period of 60 days. 2. On the other hand, Mr. Anurag Singh, learned counsel appearing for the claimant would oppose.
3. Heard counsel for the parties.
4. Perusal of the award would show that the learned Claims Tribunal exonerated the Insurance Company and fastened liability with the owner-cum-driver of the offending vehicle.

The observation made in paragraph no. 9 of judgment dated 06.01.2026 passed in MAC No. 671 of 2021 by this Court, whereby the Insurance Company is directed to pay the enhanced amount of compensation is hereby deleted and the liability shall be on the “driver- cum-owner” of the offending vehicle to indemnify the award. Instead of Insurance Company word “driver-cum-owner” is hereby substituted. This order shall be the part of the judgment passed in MAC No. 671 of 2021 dated 06.01.2026.
6. Accordingly, the review petition is disposed of. Sd/-
