JUSTICE KARDAK ETE ORDER Date : 12-06-2026 Heard Mr. A. Kakoti, learned counsel for the petitioner. Also heard Mr. N. Goswami, learned State Counsel for the respondent No. 1 and Mr. S. K. Talukdar, learned Standing Counsel Co-operation. 2. By filing this writ petition, the petitioner has prayed for a direction to complete the enquiry under Section 87 and inspection under Section 88 of the Assam Cooperative Societies Act, 2007 in respect of the affairs of Arya Smart Living Group Housing Cooperative Society Ltd. 3. Having considered that the enquiry has already been initiated by communication dated 11.08.2025, the learned Standing Counsel, Co- operation was directed to obtain instructions. Today, Mr. S. K. Talukdar, learned Standing Counsel, Co-operation, by placing on record the order dated 05.06.2026 passed by the Registrar of Cooperative Societies, Assam, submits that a direction has been issued to conduct inspection under Section 88 of the Assam Cooperative Societies Act, 2007. 4. Considering the above, I am of the considered view that the grievance raised by the petitioner has been substantially redressed, as the enquiry has already been initiated and direction has been issued to conduct an inspection under Section 88 of the Assam Cooperative Societies Act, 2007. 5. Accordingly, the writ petition stands closed with an observation that the respondent authorities shall complete the enquiry and inspection into Page No.# 3/3 the affairs of Arya Smart Living Group Housing Cooperative Society Ltd. in accordance with law. 6. It is needless to observe that if the petitioner is still aggrieved, it shall be open to the petitioner to approach this Court again. 7. The writ petition stands disposed of. JUDGE Comparing Assistant
