Heard Mr. T. Nega, learned counsel for the petitioner. Also heard Mr. D. Loyi, learned Public Prosecutor for the State respondent.
2. This is an application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking grant of pre-arrest bail to the petitioner in connection with Namtok P.S. Case No. 03/2026, registered under Sections 109(1)/ 118(1)/ 351(3)/3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. Mr. Nega, learned counsel for the applicant, submits that earlier by
order dated 29.05.2026, this Court, while calling for the case diary, granted interim pre-arrest bail to the accused/applicant and directed that, in the event of his arrest in connection with the aforesaid Namtok P.S. Case No. 03/2026, he shall be released on bail on furnishing a bail bond of Rs. 30,000/- (Rupees thirty thousand only) with one surety of the like amount to the satisfaction of the arresting authority, subject to the further condition that the accused/applicant shall cooperate with the investigation and appear before the Investigating Officer (I.O.) as and when called upon to do so. 4. It is further submitted that after obtaining interim pre-arrest bail, the accused/applicant appeared before the Investigating Officer on 31.05.2026. Upon such appearance, the accused/applicant was formally arrested in connection with the aforesaid Namtok P.S. Case No. 03/2026. His statement was also recorded and, after completion of the necessary formalities, he was subsequently released on interim pre-arrest bail on the strength of the order dated 29.05.2026. It is further submitted that since the accused/applicant has been cooperating with the Investigating Officer and has already been arrested and subsequently released on interim pre-arrest bail, the interim protection granted to him on 29.05.2026 may be made absolute. 6. Mr. Loyi, learned Public Prosecutor for the State respondent, produced the case diary and submits that after obtaining interim pre-arrest bail, the accused/applicant has been cooperating with the investigation of the case. Since his statement has already been recorded and he has been arrested and subsequently been released on bail on the strength of the order dated 29.05.2026, further custodial interrogation of the accused/applicant is no longer required. 7. In view of the above, and as the accused/applicant is fully cooperating with the investigation of the case, it appears that the further custodial interrogation of the accused/applicant may no longer be required. Moreover, the accused/applicant is not the principal accused in the case. 8. Accordingly, the interim anticipatory bail granted to the accused/applicant vide order dated 29.05.2026 is hereby made absolute, subject to the following terms and conditions: i. that the accused/applicant shall continue cooperating with the Investigating Officer/police officer and appear before him as and when required; ii.
that the accused/applicant shall not, directly or indirectly, make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such
Page No.# 4/4 person from disclosing those facts to the Court or to any police officer; iii. that the accused/applicant shall not hamper or tamper with the evidences and the witnesses of the case; and iv. that the accused/applicant shall not leave the State of Arunachal Pradesh without prior information to the I.O of the case till completion of the investigation. 9.
