This revisional application seeks expeditious disposal of a suit for partition being Title Suit No.47 of 2000 as well as the Misc. Case No.10 of 2016 both are pending before the learned Civil Judge (Senior Division), 10th Court at Alipore, South 24- Parganas. 2. It is submitted by the learned Advocate appearing for the petitioners that an ex parte preliminary decree has been passed in the suit. Thereafter an application under Order IX Rule 13 of the Code of Civil Procedure has been filed for setting aside the ex parte decree and by reason thereof both the proceedings are pending. 3. In view of the nature of the order proposed to be passed, no direction for prior service of a copy of the revisional application along with a notice on the opposite parties is being made, however, the petitioners shall remain obliged to serve a copy of 2 the revisional application along with a copy of this order upon the opposite parties within a week from date. 4. Having heard learned Advocate appearing for the petitioners and having perused the material on record this revisional application is disposed of by requesting the learned Civil Judge (Senior Division), 10th Court at Alipore, South 24-Parganas to dispose of the Misc. Case no.10 of 2016 as expeditiously as possible and preferably within a period of six months from the next date fixed. 5. Thereafter, the learned Trial Court is requested to dispose of the suit being Title Suit No.47 of 2000 as expeditiously as possible and preferably within a period of six months from the date of disposal of the aforesaid Misc. Case No. 10 of 2016 without granting any unnecessary adjournment to either of the parties. 6.
