Huda for the accused applicant and Mr. D.P.Goswami, learned Addl.Public Prosecutor for the respondent State. 2. This is an application under Section 482 of BNSS, 2023 praying for grant of pre-arrest bail to the accused/applicant, Jiarul Islam apprehending arrest in Page No.# 2/3 connection with the Kharupetia P.S. Case No. 38/2026, under Section 87 of the BNS, 2023. 3. An FIR was lodged on 22.04.2026 by one Shaha Alam alleging that her minor daughter was missing from house and later on, they came to know that one boy from their village, namely, Jeherul Islam had taken away his daughter with the intention of marrying her; that on 12.04.2026, after getting certain pressure from the informant’s family, the accused’s family handed over the minor girl to the police on 21.04.2026. 4. On receipt of the FIR, police registered Kharupetia P.S. Case No. 38/2026 under the aforementioned sections. 5. Case Dairy in the instant case has been produced. 6. After perusal of the Case Diary and taking into account the submission made by the learned counsel for accused-applicant, this Court is of the opinion that the accused-applicant should be granted pre-arrest bail. 7. Accordingly, it is directed that in the event of arrest of the accused- applicant, he shall be released on furnishing bail bond of Rs.50,000/- with a suitable surety of like amount to the satisfaction of arresting authority, subject to the following conditions: i) That the accused-applicant shall appear before the investigating officer within 10 days of passing of this order; ii) That the accused-applicant shall co-operate with the investigation and make himself available as and when called for by the investigating officer; and iii) That the accused-applicant shall not try to get in touch with the victim girl and shall not try to influence any evidence that may be involved in the instant case.
