ORAL ORDER
The petitioners are said to be tenants in Building No.628, N.R.Complex, Netaji Nagara, Tumkur Road, Chokkasandra Village, T.Dasarahalli, Bengaluru. The said property is said to be owned by respondent no.6.
On the ground that respondent no.6 has not paid the property tax, respondent nos.2 to 5-Bruhat Bengaluru Mahanagara Palike (BBMP), now Greater Bengaluru Authority (GBA) has sealed the shops of the petitioners. Aggrieved by the same, the present writ petition is filed by the petitioners with the following prayers: i) Issue a Writ of Mandamus or any other suitable directions or order directing the Respondent BBMP Officials to de-seal 10 Shops of the Petitioners number 1 to 10 with immediate effect. - 7 -

ii) Issue a Writ of Mandamus or any other suitable directions or order directing the Respondent BBMP Officials not to seal bank premises in respect of petitioner no.11 as per Annexure-D dated 09.01.2025. iii) Issue any other appropriate writ or order or direction to the Respondents as deemed fit in the circumstances of the case including payment of cost in the interest of justice and equity."
2. Strangely the writ petition does not disclose what is the exact tax due to be paid by respondent no.6 to the BBMP. Only a bald allegation is made against BBMP, now GBA that assessment has not been done properly. The petitioners/tenants are not making any claim against respondent no.6, who is the actual culprit. Respondent no.6 has not cared to file any objections nor the counsel is present before the Court when the matter is taken up for hearing. - 8 -

3. As the writ petition does not disclose what is the error on part of the BBMP, now GBA in assessing the tax, the writ petition stands dismissed. However, liberty is reserved to the petitioners to sue respondent no.6 and recover their damages, if they might have suffered due to dereliction of duty caused by respondent no.6.
