JUSTICE RAJESH MAZUMDAR O R D E R 12.06.2026 (Nelson Sailo, J) Heard Mr. A. Chowdhury, learned senior counsel through remote video conferencing and he is assisted by Ms. M. Borah, learned counsel and Mr.Abhishek Roy, learned counsel also through remote video conferencing for the applicant. 2. By filing this application, the applicant seeks condonation of 24 (twenty four) days delay in filing the connected appeal against the judgment and order dated 01.04.2026 passed in WP(C) No.5862/2024. 3. Referring to the application, learned senior counsel submits that the delay has occasioned on account of the liberty granted by the Court to the authorities concerned to review the suspension order and to pass orders within 45(forty five) days. The suspension order thereafter was reviewed on 06.05.2026 and therefore, since the same was awaited, there is delay in filing the connected appeal. The learned senior counsel submits that the applicant is mainly aggrieved with the observation made by the learned Single Judge in paragraph 139(xii) of the judgment and order under challenge. He therefore, submits that the delay in filing the connected appeal may be condoned. 4. Mr. D. Nath, learned Senior Government Advocate appearing for the respondents submits that in view of the explanation tendered by the Page No.# 3/3 applicant, Court may consider the same and pass an appropriate order as it deems fit and proper. 5. Upon hearing the learned counsel for the parties and on perusal of the statements made in the application, we find the explanation tendered to be sufficient for condonation of the delay. 6. Accordingly, the delay of 24 (twenty four) days in filing the connected appeal stands condoned. 7. Interlocutory application stands disposed of. 8.
