Learned counsel appearing on behalf of the petitioner submits as follows. The deceased victim was allegedly having an illicit affair with one Manuwara Bibi. The petitioner happens to be the uncle of said Manuwara Bibi. He has been falsely implicated in this case. The victim died after receiving injuries in a railway accident. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He submits that, apart from the statements of the accused, there is a phone call record, which shows that immediately before the incident the brother of the said Manuwara Bibi had called the victim. Purportedly, the call was made asking him to come near the railway track. Two brothers of the said Manuwara Bibi and the present petitioner were present there. The statements of the Loco Pilot show that the body of the victim was lying on the railway track before the train ran over it. The petitioner 2 has a criminal antecedent involving the charge of murder. He was on bail. Further investigation is pending. Considering the above, the incriminating materials available in the case diary and the fact that the petitioner has a criminal antecedent involving a charge of murder, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. The personal appearance of the Investigating Officer is noted and is dispensed with. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
