2. The present Criminal Misc. Application has been filed seeking quashing of the complaint being Criminal Case No. 2647 of 2025, “Saran Biotech vs. Chirag Shah”, instituted under Section 138 of the Negotiable Instruments Act, 1881, along with the cognizance/summoning
order dated 20.01.2026, passed by the learned Additional Chief Judicial Magistrate/IIIrd Additional Civil Judge (Senior Division), Rudrapur, District Udham Singh Nagar.

Learned counsel for the applicant submits that during the pendency of the aforesaid proceedings, the learned trial Court, vide order dated 28.04.2026, has issued bailable warrants against the applicant. It is further submitted that the applicant undertakes to appear before the Court concerned and cooperate with the proceedings. It is, therefore, prayed that till the applicant appears before the Court below, the effect and operation of the order dated 28.04.2026 issuing bailable warrants may be kept in abeyance.
4. Considering the aforesaid submission and without expressing any

2026:UHC:5687 opinion on the merits of the case, this Court is of the view that the interest of justice would be served by granting limited interim protection to the applicant.
5. Accordingly, as an interim measure, the effect and operation of the
order dated 28.04.2026 issuing bailable warrants against the applicant shall remain kept in abeyance till 24.07.2026. However, the applicant is directed to appear before the Court concerned on 24.07.2026 and cooperate with the proceedings. It is made clear that this interim protection is subject to the applicant's appearance before the Court below and shall not be construed as an expression on the merits of the case.
6. With the aforesaid observations and directions, the present Criminal Misc. Application stands disposed of.
