1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.153/2024, registered at Police Station Wizirpur, District Gangapur City, for the offence(s) under Sections 420, 467, 468, 471 and 120-B of IPC.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is contended that the main allegation of impersonation deceiving the complainant are against Late Fakeer Chand and beneficiary co- accused Shyam Singh. The co-accused Shyam Singh has already been enlarged on bail by the Co-ordinate Bench. It is also
[2026:RJ-JP:22179] (2 of 3) [CRLMB-7465/2026] contended that the co-accused Shyam Singh sold the property to Amjad and the petitioner purchased the property from Amjad and has not committed any forgery. The petitioner is a bona fide purchaser, the charge-sheet has yet not been submitted and the investigation of the case will take considerable time, therefore, the bail application of the accused-petitioner may be allowed.
3. Learned Public Prosecutor as well as learned counsel appearing on behalf of the complainant have vehemently opposed the bail application. It is contended by learned counsel for the complainant that the petitioner is part of the conspiracy as he in connivance with co-accused Shyam Singh sold the disputed property, which was earlier sold to him by late Fakeer Chand by impersonating as Banwari. It is also contended that co-accused Shyam Singh, who is the real culprit, has again sold the property to Amjad. The property was sold within 11 days and the petitioner is a member of the organized crime, therefore, the bail application of the petitioner may be dismissed.
4. Heard and perused the material available on record.
5. Considering the fact that the main co-accused Shyam Singh has already been enlarged on bail by the Co-ordinate Bench, without expressing anything on the merits of the case, this Court deems it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner- Namonarayan @ Guddu S/o Anoop Singh, in connection with FIR No.153/2024, registered at Police Station Wizirpur, District Gangapur City, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of
